7-hydroxymitragynine occupies an unusual legal position: at the federal level in the United States it is not a scheduled controlled substance, but a growing number of states and municipalities have restricted or banned it independently. That means legality is a local question, not a national one.
Why The Position Varies So Much
Kratom and its alkaloids sit in a regulatory grey zone. Federal agencies have considered scheduling actions in the past without completing them, leaving the field open for individual states to act. In practice that has produced three broad categories of jurisdiction, plus a fourth for outright bans.

United States — What To Check
When confirming your position in a US state, work through these four questions in order:
- Does your state have a kratom statute? — Some states regulate kratom generically while 7-OH-specific legislation has moved separately. Both can apply to the same product.
- Has your state passed 7-OH-specific legislation? — A number of states have introduced or passed restrictions aimed specifically at 7-hydroxymitragynine products rather than kratom as a whole.
- Does your city or county have its own ordinance? — Municipal bans exist in states that are otherwise permissive.
- Is there an age restriction? — Most regulated states set 21+. We enforce 21+ everywhere regardless.
